Terms of Service

Thank you for using Inner Orbit. These Terms of Service ("Terms") govern your use of the Inner Orbit app, Apple Watch app, and any related services (collectively, the "Service"). By using Inner Orbit you agree to these Terms. If you don't agree, please don't use the app.

1. What Inner Orbit is

Inner Orbit is a private presence app. It lets you stay gently connected to a small, invited group of people, your "orbit" (3–8 people). There are no public profiles, no feed, no ads, and no algorithmic content. Everything you share is visible only to the members of your orbit.


2. Eligibility

You must be at least 13 years old to use Inner Orbit (or at least 16 years old if you are in the European Economic Area). By creating an account, you confirm that you meet this requirement.

Inner Orbit is invite-only. You may only create an account if you have received an invitation from an existing orbit member or from us.

5. Acceptable use

You agree to use Inner Orbit only for lawful, personal, non-commercial purposes and in a way that respects the other members of your orbit.

6. Your content

What you own

You retain ownership of the content you create and share on Inner Orbit, your profile, status updates, photos, voice notes, moments, and other posts ("Your Content").

The license you give us

By sharing content on Inner Orbit, you grant us a limited, non-exclusive, royalty-free license to store, process, and transmit Your Content solely as necessary to operate the Service and deliver it to your orbit. We do not claim ownership of Your Content and we do not use it for any other purpose.

Your responsibility

You are responsible for the content you share. Do not post content that is illegal, defamatory, or that violates another person's privacy or intellectual property rights.

Deletion

When you delete content or delete your account, we remove Your Content from our systems as described in our Privacy Policy.


7. Privacy

Your use of Inner Orbit is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it, it explains what data we collect, how we use it, and the controls you have over it.


8. Third-party services

Inner Orbit is built on Google Firebase (Authentication, Firestore, Cloud Functions, Cloud Storage, Cloud Messaging, Crashlytics). By using Inner Orbit, your data is also processed by Google subject to their terms and policies. We are not responsible for the practices of third-party service providers, but we have chosen them carefully and require them to protect your data.

The app is distributed via Apple TestFlight and, in the future, the Apple App Store. Your use of those platforms is subject to Apple's terms.


9. Intellectual property

Inner Orbit, its name, logo, design, and all original content we create are owned by us and protected by intellectual property law. These Terms do not grant you any right to use our name, logo, or branding.

10. Disclaimer of warranties

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the fullest extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the Service, including loss of data, loss of privacy, or loss of goodwill, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or the Service will not exceed the amount you paid us in the twelve months preceding the claim (which, during a free beta, is $0).

Some jurisdictions do not allow limitations on implied warranties or liability for consequential damages, so some of the above may not apply to you.


12. Indemnification

You agree to defend, indemnify, and hold harmless Steve Chan from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Service, (b) Your Content, or (c) your violation of these Terms or any applicable law.


13. Termination

By you

You may stop using Inner Orbit at any time and delete your account in the app. Deletion removes your data as described in the Privacy Policy.

By us

We may suspend or terminate your access at any time, with or without notice, if we reasonably believe you have violated these Terms, if we discontinue the Service, or for any other reason at our discretion. We will try to give advance notice when feasible.

Effect of termination

On termination, your right to use the Service ends. Sections 6, 9, 10, 11, 12, and 14 survive termination.


14. Governing law and disputes

These Terms are governed by the laws of England & Wales, without regard to its conflict-of-law principles.

If you have a dispute with us, please contact us first at [email protected], we'd like the chance to resolve it informally.

If we cannot resolve a dispute informally, you agree that the courts of England & Wales will have exclusive jurisdiction over any dispute arising out of or relating to these Terms, except that you may also be entitled to bring proceedings in your country of residence if local consumer law gives you that right. Nothing in these Terms affects your statutory rights as a consumer.

If you are an EEA or UK resident, nothing in this section limits your right to bring a claim before your local courts or to use your statutory dispute resolution rights.


15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and notify you via the app or by email. Continued use of Inner Orbit after changes take effect means you accept the updated Terms.
